1 - PRICE 1.1
- The prices of our products are in euro (VAT included) except the expense for shipping and handling.
1.2 - For all orders except those orders shipped within France, the purchaser will be the importer. For all orders sent outside France, European Union, and DOM/TOM, customs charges, importation fees, and taxes are likely to be owed. All fees including processing of paperwork, customs fees, taxes or any other charges are the responsibility of the purchaser. We recommend you enquire about these charges, fees, and regulations before placing any order.
1.3 - All orders are payable in Euro.
1.4 - kiwi reserves the right to change its prices at any time. Your orders will be invoiced on the basis of rates in force when your order is received, recorded and confirmed by Kiwi. Until complete payment is received, Kiwi remains the owner of all invoiced items.

3 - VALIDATION OF ORDER When you click "To Validate" this will confirm your order and your agreement to accept all Conditions of sales which includes your confirmation of the order placed and your agreement to make payment to Kiwi.
4 - AVAILABILITY Due to the high demand for Kiwi, items placed on your order may not be available to be shipped. If items are not available, a customer service representative from Kiwi will contact you.
5 - DELIVERY Kiwi typically makes its shipments by "Colissimo suivi". The estimated time of delivery for shipments within France is 8 - 15 working days after receipt of your order. The estimated time of delivery for shipments outside France is 15 to 20 working days. At the time your order is shipped a tracking number will be assigned. This tracking number will allow you to follow your order by going to the website: www.coliposte.net site. Kiwi reserves the right to use other means of delivery.
5-1 "Colissimo Suivi" service estimates a 48 h delivery within France, except weekend and holidays and gives you the possibility to recover products ordered at your closest post office in case of your absence during the presentation by the postman. If you are away the day of delivery, your postman will leave a calling card in your mailbox. It will allow you to withdraw your package in your post office during the opening hours, within 15 days.
5-2 It is up to the addressee to check expeditions and to make claims which would appear justified, even to refuse the package, if this one is likely to have been opened or if damaged.
5-3 Nevertheless, it is possible, as in any expedition, that the delivery can be delayed or that the package gets lost. In case of delay of delivery or in mislaid package, we ask you to signal it to us by email at email@example.com. We will contact the Post office to start up an inquiry. An inquiry can last up to 21 days as from the date of the beginning of the inquiry. If during this delay, the package is found, it will be sent immediately to you. If the package is not found at the end of the delay of 21 days of inquiry, "La Poste" considers the package as lost. In that case only, we will send you a product of replacement. If the ordered product is not available any more, we will reimburse your order. We decline any responsibility as for the lengthening of delivery time due to the conveyor, notably in case of loss of products or strike.
5-4 In case the conveyor cannot deliver (due to a wrong address or a non-approval of the package by the customer), the package will be sent back to KIWI and a credit will be issued minus transportation expenses. If a package is not claimed at Post office (after 15 days), the package will be returned to KIWI. A Kiwi customer service representative will then contact you.
6 - PAYMENT Purchase payment can be made by: Bank card: Visa, MasterCard, and international Credit card.
7 - SECURITY Kiwi uses ATOS WORLDLINE internet site system of security.
8 - RETURN POLICY
8. 1 - In accordance with articles L 121-20 and following of the code of consumption, the customer has 7 days from receipt of delivery to return or exchange any item ordered without having to give any reason or to pay penalties except for shipping expenses. You must return the item(s) in their original condition and packaging (including all attached garment tags/designer tags) unused and unwashed to: KIWI Service client e-boutique Parc d'activitŽs - 12 rue Francois Arago 83310 - Cogolin FRANCE Damaged, dirty, or incomplete articles will not be reimbursed. Please send your package via a prepaid, insured, traceable method to ensure a safe and documented delivery. Refunds are only made on the products. No refunds on the shipping costs.
8.2 - Shipping and handling charges are refundable if a mistake is determined to have been made by Kiwi. Once the returned items have been received, in acceptable condition by Kiwi, a replacement or a credit will be issued. 8.3 - Exchange or reimbursement cannot be done at Kiwi Store.

12 - RESPONSIBILITY The offered products comply with French legislation in force. The responsibility of KIWI would not be involved in case of non respect for the legislation of the country where products are delivered. It is up to you to prove to local authorities the possibilities of importation or use of products or services which your plan to order. We try to ensure that items' pictures and illustrating texts are as accurate as possible but slight variations between the pictures and the items themselves must be expected. Kiwi shall not be liable to you or in beach of this agreement for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control (fire/strike/inundation...) Kiwi shall not be liable to you in connection with this agreement in contract, tort or otherwise for any loss arising out of any event, any internet network or virus problem, for any loss or profit, anticipating savings or data and/or any indirect loss.
13 - APPLICABLE RIGHT - LITIGATIONS The present contract is subjected to French law. The language of the present contract is the French language. In case of the only litigation the court of Draguignan is competent.

16 - Gift card -The gift card can be used only on www.kiwi.fr, this card is not accepted in Kiwi Saint Tropez's stores -The gift is valid with unlimited duration -The gift card can be used only once, if the total amount is not used it will be lost -No refund are made on gift cards only exchange -It's impossible to use a gift card code after checkout your cart
17 - Personal data protection Customers are hereby informed that their personal data may be collected on the Website and used by KIWI SAINT-TROPEZ, which acts as data controller within the meaning of the Regulation (EU) 2016/679 of the European parliament and of the council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter “General Data Protection Regulation” or “GDPR”). KIWI SAINT-TROPEZ undertakes to protect and ensure the security and confidentiality of its Customers’ personal data in accordance with the GDPR, including by taking all appropriate measures to prevent these data from being distorted, damaged or accessed by unauthorised third parties. In particular, Customers’ personal data may be sent to service providers and contractual partners which, acting as subcontractors within the meaning of the GDPR, contribute directly to the management of Orders and for which it is absolutely necessary to access the personal data entered by Customers when creating and using their Accounts (identity, postal address, telephone number, email address). Subcontractors may act only under instruction from KIWI SAINT-TROPEZ. Customers’ personal data are collected for the following purposes: - to manage Orders and relationships with Customers; - to inform Customers about commercial offers and information relating to the brand; - to reinforce and enhance communication from the Website and the brand by sending, for instance, newsletters and special offers depending on the preferences that Customers express on the Website - to improve and personalise the services offered to Customers; and - to comply with legal and regulatory obligations. Customers’ personal data are retained only for the period strictly necessary for the aforementioned purposes. In accordance with the French Data Protection Act, Customers have the right to access, correct and object to the use of their personal data (hereinafter “Data Protection Rights”).
